میرے خاوند اور میرا آپس میں کسی بات پر جھگڑا ہوا تو اس جھگڑا کی بنا پر میرے خاوند نے مجھے میری ماں کے گھر چھوڑ دیا مجھے ماں کے گھر آئے ہوئے تین سال کا عرصہ گزر گیا ہے ۔میرا چار سال کا بیٹا بھی ہے مجھے کسی کہنے والے نے بات کہی کہ اگر میاں بیوی کے تعلق میں طویل عرصہ گزر جائے اس صورت کے اندر میاں بیوی کا نکاح ٹوٹ جاتا ہے

۔آپ سے پوچھنا چاہتی ہوں کہ باہر کے ملک میں رہنے والے لوگ یہ تو گھر میں سالوں بعد آتے ہیں ۔اس مسئلہ کی حقیقت کیا ہے کیا نکاح فاسد ہوجاتا ہے یا نہیں ہوتا ۔اگر میاں بیوی کے قربت کو طویل عرصہ گزر جائے ۔طویل سے مراد جب خاوند نے بیوی کو ایک طلاق دی ہو اس کو طلاق رجیح کہتے ہیںایک طلاق دینے کے بعد میا ں بیوی آپس میں رجوع کرسکتے ہیں ان کے پاس تین مہینے کا وقت ہوتا ہے ۔اس کے اندر میاں بیوی آپس میں رجوع کرنا چاہیں تو کر سکتے ہیں۔ اگر تین ماہ کا عرصہ گزر گیا ہے ۔اب وہ میاں بیوی آپس میں نہیں رہے ۔ ان کا نکاح فاسد ہوجائیگا ۔ یہ جو فاسد ہوگا یہ کس طریقہ کا ہوگا ۔اگر عورت میاں بیوی چاہیں کے دوبارہ اکٹھے رہیں تو صورت کے اندر وہ صرف تجدید نکاح کریں گے اس کیلئے حلالہ کی ضرورت نہیں ہے ۔میاں بیوی نیانکاح پرواہ لیں گے حق مہر بھی نیا ہوگا آپس میں نکاح کرلیں گے ۔حلالہ کی ضرورت نہیں ہے دوبارہ ویسے زندگی گزاریں گے لیکن آپ کے پاس دو چانس باقی ہیں

۔ایک مہلت نکل جاتی ہے اب دو رہ جائیں گی ایک طلاق کے بعد رجوع کرلیا اس نے اگر تین مہینے سے پہلے رجوع کریں تو کچھ نہیں ہوگا میاں بیوی ہی رہیں گے ۔پھر بھی دو مہلتیں باقی رہیں گے ۔اس صورت میں فقہاء فرماتے ہیں ایک طلاق کے بعد آپکا عرصہ اتنا گزر گیا ہےتو اس صورت میں آپ کو طلاق واقعہ ہوجائیگی تو آپ میاں بیو ی نہیں رہیں گے بیوی چاہے تو نکاح کرے یا آگے کسی سے نکاح کرسکتی ہے ۔شریعت نے اس کی کوئی عدت مقرر نہیں کی ہے کہ آپ تین دن بعد قربت کریں چاردن بعد کریں شریعت نے کہا کہ اپنی طاقت کے مطابق تم چاہو تو قربت کرسکتے ہو۔جس طرح چاہو آپ کرسکتے ہو شریعت نے اسے متعین نہیں کیا ہے یہ کہنا کہ طویل عرصہ گزر گیا ہےتو نکاح فاسد ہوگیا ایسی بات نہیں ہے آپ چاہیں سال نہ کرو دوسال نہ کرو تو کوئی مسئلہ نہیں ہے بلکہ جو اوپر بیان کیا جاچکا وہ اصل مسئلہ ہے ۔
